How to Know Future Medical Costs

for Vioxx Victims and Other Cases

The giant pharmaceutical companies will most certainly defend themselves vigorously in upcoming defective pharmaceutical cases.  This fact underscores the importance of having the most credible Future Medical Costs Analysis possible.  Clients suffering damages due to Vioxx usage will present with both obvious and subtle medical damages.

For instance, while the stroke victim with permanent disability has clear needs for assistance, the heart attack victim who is already back to work may have more subtle damages.

Patients with a previous myocardial infarction (heart attack) present an increased risk of stroke,1 future heart attack, and other health problems.  One of the many long-term problems related to heart attacks is that vessels around the site of the injury can become leaky – a side effect of localized oxygen deprivation.2  Offsetting the risks created by this and other “hidden” damages residual to strokes and myocardial events may require long-term medical responses including pharmocological therapy, periodic tests, and routine physician monitoring.

Any time you have a case involving serious injuries, call Expert Assessments, LLC for a no-cost, no-obligation initial consultation.  You may find that a Future Medical Cost Analysis will help ensure a fair settlement.    Neal S. Taub, MD conducts E.A.’s Future Medical Cost Analyses as follows:

Medical Record Review: First, Dr. Taub reviews the existing medical record to confirm the treating physician’s findings.  When findings are confirmed, Dr. Taub uses his 19 years of medical and rehabilitation experience to determine the future medical needs of the injured party.  This analysis includes standard expectations for follow-up procedures, lab work, physician visits, equipment, nursing, etc. over the life expectancy of the patient.  Expert Assessments, LLC presents the final report to the client’s treating physician for approval and/or revision.  The treating doctor then signs the analysis indicating that he/she finds the report to be real and accurate.

Determining Medical Costs: Expert Assessments establishes medical costs by utilizing regional prices (relative to the injured party) and national prices.  Fees for procedures are determined by surveying local providers.  Medication costs are determined by checking current prices at a national pharmacy.  E.A. determines lab costs and other costs by surveying regional providers.

Attorneys should consider E.A.’s Future Medical Cost Analysis as an expert assessment and a conservative estimate of medical expenses over the patient’s life expectancy.  This analysis alone does not take into account unforeseen complications, inflation, or future price increases.  However, Expert Assessments, LLC also offers the expert services of an economist who can provide settlement structure plans designed to protect the real value of a settlement against future economic and pricing uncertainties.  The Future Medical Cost Analysis alone will facilitate a full and fair settlement by identifying ongoing medical expenses and providing realistic current pricing for the specified medical care.
